Welcome to OpisFind. These Terms of Service ("Terms") explain the terms by which you may use our online services, website, and software (collectively the "Service"). By accessing or using the Service, you signify that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

1. Use of Service

1.1 Eligibility

You may use the Service only if you are a natural person and can form a binding contract. Any use or access to the Service by anyone under the age of majority in the state in which they reside is strictly prohibited.

1.2 Our Service

OpisFind is a marketplace that enables users to compare various financial products from financial institutions such as lenders and banks ("Providers"). We are not a financial institution (i.e., we are not a bank or a lender).

1.3 Your Consent to Collect and Transmit Information

Your use of the Service requires the collection and transmission of your personal information. You authorize OpisFind to transmit your information to Providers in order to provide you with personalized rates, quotes, and offers.

2. Credit Inquiries

2.1 Soft Credit Inquiries

When you use our Service, you consent to a soft credit inquiry of your credit report. Soft credit inquiries do not affect your credit score and are used to assess your credit profile for prequalified rates.

2.2 Hard Credit Inquiries

OpisFind does not conduct hard credit inquiries. However, when you submit an application for credit with a Provider, the Provider may perform a hard credit inquiry, which may affect your credit score.

3. Communication Consent

3.1 Telephone Calls and SMS Messages

By providing your telephone number, you authorize us and our Providers to call and/or send text messages, even if your telephone number is registered on any Do Not Call list. You may opt out at any time by following the instructions provided in our communications.

3.2 Electronic Communications

You agree to receive all communications, agreements, documents, notices, and disclosures electronically. We will provide these by posting them on our website and/or by emailing them to you.

4. Prequalified Rates

Prequalified rates are potential options, not offers of credit. All credit decisions are determined by Providers in their sole discretion. Receiving a prequalified rate does not guarantee that a Provider will extend you an offer of credit. Rates are subject to change based on various factors.

5. User Content and Conduct

You agree not to:

• Post any false, deceptive, or misleading information
• Post any private information about yourself or others
• Use the Service for any illegal or unauthorized purpose
• Interfere with or disrupt the Service
• Attempt to gain unauthorized access to any portion of the Service

6. Privacy and Security

We care about the privacy and security of our users. You understand that by using the Service, you consent to the collection, use, and disclosure of your personally identifiable information as set forth in our Privacy Policy.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND ON AN "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED.

We do not guarantee:

• The accuracy or reliability of any information provided through the Service
• That the Service will be uninterrupted or error-free
• That any Provider will approve your request for credit
• The terms, rates, or offers from Providers

8. Limitation of Liability

TO THE EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL OpisFind BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

9. Dispute Resolution

9.1 Informal Resolution

Before filing any formal dispute, you agree to first contact us to attempt to resolve the issue informally by sending a written notice to our address.

9.2 Arbitration Agreement

Any dispute between you and OpisFind will be resolved through binding arbitration, rather than in court, except for disputes that may be brought in small claims court.

9.3 Class Action Waiver

YOU AND OpisFind AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS ACTION.

10. General

10.1 Governing Law

These Terms will be governed by the laws of the State of North Carolina, without regard to its conflict of law provisions.

10.2 Changes to Terms

We may modify these Terms from time to time. If we make changes, we will post the changed Terms on the Site and indicate the date they were last revised. Your continued use of the Service constitutes acceptance of the new Terms.
